Samsung drags Apple’s iPhone 5 to long running patent lawsuit

The trial for the claim is scheduled to be held in 2014

South Korea based Samsung Electronics has escalated its patent war against Apple by claiming that its new iPhone 5 infringes eight of Samsung’s patents associated with implementation of LTE technology.

Samsung’s move follows its winning of a court ruling that ordered removal of a ban on US sales of the Galaxy Tab 10.1 tablet computer.

The company claimed that Apple has infringed innovations include a technology that synchronises photos, music and video files across several devices, and a means to capture and send video online.

Samsung’s new filing against Apple is an addition to earlier lawsuit filed on 18 April 2012 at the US federal court, which is scheduled for trial in 2014.

The South Korean firm’s original lawsuit classifies the same eight patents as the basis for alleging infringement by earlier iPhone devices, in addition to the iPad and iPod Touch.

Samsung said in a statement that the company has always preferred to compete in the marketplace with its innovative products, rather than in courtrooms.

"However, Apple continues to take aggressive legal measures that will limit market competition. Under these circumstances, we have little choice but to take the steps necessary to protect our innovations and intellectual property rights," Samsung said.

Earlier in April, Apple had received $1.05bn in damages from Samsung in a separate patent lawsuit in the same court.

However, Samsung had won a ruling against Apple in August which claimed that Apple had infringed two of its wireless communication patents in South Korea and the court had ordered Apple to pay $35,000 in damages.
