US District Court Judge David Kenyon followed his reversal of a temporary restraining order granted on behalf of Microsoft Corp against Z-Nix Co Inc by issuing a court order denying Microsoft a temporary restraining order against several Z-Nix distributors, and denied Microsoft’s request for a preliminary injunction hearing against the distributors; attorneys for Z-Nix argued that Microsoft misled the court into granting the temporary restraining order against Z-Nix and several distributors through outrageous concealment and distortion of the facts; Microsoft had claimed to the court that Z-Nix, which has paid nearly $3m in royalties to Microsoft since 1990, was involved in a massive distribution scheme to sell pirate copies of Windows 3.1.
