US District Court Judge Lucy Koh, who is reviewing the long running patent trial between Apple and Samsung Electronics, has denied the iPhone maker’s request to ban 26 Samsung products from sale.
The judge is currently reviewing a jury’s decision to award Apple $1.05bn in damages against Samsung in August this year.
Koh, who made a final plea for a truce between the two firms earlier this month, said that Apple had failed to prove the infringing products affected its sales.
In her ruling Koh said: "The fact that Apple may have lost customers and downstream sales to Samsung is not enough to justify an injunction. Samsung may have cut into Apple’s customer base somewhat, but there is no suggestion that Samsung will wipe out Apple’s customer base or force Apple out of the business of making smartphones," Koh said.
After winning $1.05bn damages, the iPhone maker had several setbacks in its various legal trials with rival Samsung.
Last month, Apple was ordered by a US judge to reveal all details of its deals with HTC to Samsung, in response to recent plea by the South Korean company.
In October this year, Apple had lost its patent case against Samsung in London’s Court of Appeal, after a judge ruled that the Galaxy tablet does not infringe the iPad’s design.
