US Judge Lucy Koh has set a new trial date to find whether $450.5m of damages awarded in favour of Apple by a jury to stand in the long running patent battle with its rival Samsung Electronics.
The federal court also ordered that both the companies will not be permitted to expand the scope of the damages based on new sales data, new products and new methodologies or theories and the case will proceed with the same evidence and same legal theories on damages as the first trial.
Apple had a major setback earlier this year when Koh cut about $450.5m from the $1.05bn in damages that the iPhone maker was awarded in its patent suit against Samsung in August 2012.
Koh previously said the jury had improperly calculated part of the award and ordered for a new trial in which damages will be reassessed.
Koh rejected Samsung’s proposal to delay a new damages trial and set a trial date of 12 November this year.
The new trial will involve devices such as Samsung’s Gem, Galaxy S II, Infuse 4G, Droid Charge, Galaxy Tab, Nexus S 4G, Prevail, Epic 4G as well as several other products.
Previously, Koh refused Apple’s request to increase damages in the suit and denied the company’s request to ban 26 Samsung products from sale.
Samsung and Apple have both scored victories in their patent battles in different countries since the iPhone maker accused the South Korean firm of infringing its devices.
