A Judge at the US District Court for the Northern District of California has allowed iPhone 5 Galaxy Note 10.1, Galaxy S III and Android 4.1 operating system to be added to the ongoing patent battle between iPhone maker Apple and South Korea based Samsung.
The court allowed Samsung Electronics to include iPhone 5 in its patent infringement claims, while it has also allowed the iPhone maker to pursue patent claims against Samsung’s new smartphone’s and Android 4.1 operating system.
Magistrate Judge Paul Grewal said that Apple’s latest tablets may also be dragged into the lawsuit following Samsung’s request.
"Given the early stage of this litigation and the reasoning of this order, the court notes that Apple should think twice before opposing similar amendments reflecting other newly-released products — e.g. the iPad 4 and iPad mini — that Samsung may propose in the near future," Grewal said.
The case is one of two patent infringement pending suits in the US District Court in San Jose by US based smartphone maker against South Korean firm.
In August 2012, a jury ordered Samsung to pay about $1.05bn to Apple as damages of infringing its patents.
Another case in the UK ruled that Samsung had not violated Apple’s iPad patent during its designing of Galaxy devices and had also ordered Apple to issue an apology.

US smartphone maker had won some patent wars against Samsung in Germany while has also lost them in Japan and the Netherlands, with further lawsuits anticipated to trail.
Recently, Samsung ruled out that it has no plans to settle patent infringement battle with Apple, while both firms have accused each other of infringing copyrights on patented designs and technology.
