Samsung has confirmed in its latest court filing that Apple may receive more than $1.05bn in damages as part of a new patent-infringement trial, compared to its originally awarded damages in August 2012.
Following Judge Lucy Koh’s decision to reduce more than 40% of the initial $1.05bn damage against Samsung over improper assignment of damages for some devices, Samsung has been seeking a new trial for the vacated amount.
In addition, Samsung urges the new jury to reconsider whether the 14 products added in the vacated sum actually infringe on patented technologies of Apple.
FOSS Patents’s Florian Mueller cited Samsung’s filing, which notes: "Apple can seek even more damages on these products in the new trial."
The new trial will include Samsung’s devices including Gem, Galaxy S II, Infuse 4G, Droid Charge, Galaxy Tab, Nexus S 4G, Prevail, Epic 4G in addition to several other products.
Earlier, Koh declined Apple’s request to increase damages in the lawsuit and rejected the firm’s request to ban 26 Samsung products from sale.
Both the firms have had several obstacles in their various legal trials in different countries globally.
