PREDATORY PRICING: THREE DUTCH LEASERS TAKE IBM TO COURT

Three Dutch leasing companies that together account for 60% of the local third party computer leasing market are taking IBM Nederland to court in Amsterdam under Article 86 of the Treaty of Rome, which covers misuse of dominant market position within the European Economic Community. The three are the ICA subsidiary of Atlantic Computers Plc, the Dutch subsidiary of IBL Plc, and Econocom NV, and the trio charge IBM Nederland and its leasing subsidiary with discriminatory sales activities including predatory pricing, in an attempt to monopolise the leasing market. Details of the complaint are also going to the European Court of Justice.
