Oracle refused Google’s offer to pay a percentage of Android revenue if the former could prove patent infringement of the mobile operating technology at an upcoming trial.

According to Oracle, the offer was too low.

Oracle had sued Google in 2010, alleging that the search engine company’s Android technology infringed Oracle’s Java patents, according to Reuters.

Now a trial is set for April 16 before District Judge William Alsup in San Francisco Federal Court.

Google offered to pay Oracle roughly $2.8m in damages on the two patents remaining in the case, for the period through 2011.

It said it would pay Oracle 0.5% of Android’s future revenue for one Java patent expiring this year end and 0.015% of revenue for the other expiring in April 2018.

But, Oracle is seeking hundreds of millions in damages.

"Oracle cannot agree to unilaterally give up its rights, on appeal and in this court, to seek full redress for Google’s unlawful conduct," Oracle said in a filing.
