NOVADIGM CHIEF REBUFFS MARIMBA OVER LAWSUIT

The claims and counter claims in the pending patent infringement lawsuit between rival push technology specialists Marimba Inc and Novadigm Inc look set to continue as Novadigm chief executive and chairman, Albion Fitzgerald rebuffed the latest round of comments made by Kim Polese, his opposite number at Marimba, in which she described the suit as frivolous and baseless (CI No 3,235). Her comments are nothing more than you would expect from a defendant in a case of this type, whatever its merits, he said, claiming that, aside from hype Novadigm’s success relative to Marimba’s is indisputable. He claimed the company and its partners had generated nearly $50m in revenues from its technology, $15m more than 1997 estimates by market analyst firm Forrester Research Inc for the total push market, including Marimba.
