Nintendo of America Inc has suffered two reverse – US Judge Leonard Sand of New York denied its claim that a patent held by Magnavox Co and Sanders Associates Inc was unenforceable because of alleged patent fraud: Nintendo sued Magnavox and Sanders in 1986, contending that their US Patent No 28,507 on types of movement on a cathode ray tube screen, was invalid, not infringed and unenforceable because of the alleged fraud on the Patent Office; Magnavox and Sanders countersued Nintendo for infringement; Nintendo’s allegation of fraud was on the basis that it believed Magnavox’s attorneys knew of a seminal computer video game called Space War, played in the early 1960s; and Nintendo is barred from suing retailers selling Atari Tengen games.
