A Chinese court has thrown out a software piracy case brought by Microsoft Corp, ruling that the US software giant had not proven it was suing the right company. Microsoft began proceedings saying it discovered more than 50 computers installed with pirated Microsoft software at the Yadu Science and Technology Group (CI No 3,797). But Beijing Number One Intermediate Court has ruled against Microsoft saying it had not proved Yadu Science and Technology Group was the correct defendant.
Microsoft said it was very disappointed by the decision and claimed it had provided a solid basis for its legal action. In a case tinged with farce, evidence centered on whether the pirated software was on machines owned by Yadu Science and Technology Group or Yadu Science and Technology Company, who both shared space in the same office block.
