MICROSOFT CHARGES APPLE

Microsoft Corp, Redmond, Washington, has filed its answer, affirmative defenses and counterclaims to the March 17, 1988, complaint filed by Apple Computer Inc against itself and Hewlett Packard Co for alleged copyright infringement. The company claims that Apple violated its contracts with Microsoft, acted in bad faith and hurt Microsoft’s relationship with other companies. It does not claim specific damages, but accuses Apple of publicising the lawsuit, and seeking, stimulating and influencing press coverage of its claims to Microsoft’s detriment, and suggests that its intention in bringing the suit was to damage Microsoft. It also points out that a 1986 Apple charge of copyright infringement was not pursued after Microsoft’s lawyer responded.
