Remote access server and router manufacturer Livingston Enterprises Inc, has responded to a suit filed against it by US Robotics Inc in October with a counter claim. The Pleasanton, California-based company’s suit seeks to recover financial damages and place an injunction to prohibit US Robotics’ improper use of trade secrets gained from a previous licensing agreement between the two. Under the agreement, which dates back to 1994, US Robotics gained access to Livingston’s Postmaster ComOS remote access operating system which US Robotics used in its NetServer product and its Total control Enterprise Network Hub. According to Livingston, US Robotics has failed to return the ComOS source code as required by the terms of the licensing agreement. In October, USR filed against Livingston alleging breach of contract and unfair trading practices.
