The Department of Justice has objected to Microsoft Corp’s request to maintain certain documents related to the Windows 98 antitrust case under seal. Redmond filed the motion on May 18, arguing that the contents are confidential and should remain so. Justice said in a filing Monday that that explanation is not sufficient reason for maintaining the seal. Microsoft has to prove that the documents obtain trade secrets or other confidential research, development or commercial information. The rules are not intended to shield the disclosure of unflattering or embarrassing commercial information that indicates a party has engaged in unlawful conduct, says Justice in its filing. The trial is scheduled to begin September 8.
