On Monday, Google had asked the judge to accept a brief that called for changes to Windows Vista, because it claimed Vista desktop search was set up to favor Microsoft’s search program over rivals’. But US district judge Colleen Kollar-Kotelly yesterday said Google should take its complaint to the Department of Justice.

I do rely on the [DoJ] as the representative of consumers, Kollar-Kotelly said yesterday. The plaintiffs, as far as I’m concerned, stand in the shoes of the consumer.

She said Google was not part of the original antitrust lawsuit and, therefore, had no legal ground in the case.

Microsoft had previously struck an agreement with the Department of Justice, in order to deal with Google’s complaints in this matter. But Google said that agreement did not go far enough and had asked Kollar-Kotelly to intervene.
