We told you that with Judge David Edelstein to contend with, IBM Corp would have a far-from-easy time trying to get its anti-trust consent decree rescinded, and so it has proved: Judge Edelstein is now 84, but is as feisty as ever and IBM lawyers filed a motion on Tuesday urging the judge to recuse himself on grounds that he harbours a deep-seated antagonism against IBM that makes fair judgement impossible; IBM’s veteran lead counsel, Thomas Barr, according to a transcript of the meeting, told the judge he will not be surprised to know that IBM will ask him to recuse himself from the case – We have been down that road unhappily several times before, the Wall Street Journal quotes him saying – And you have lost each time, an unmoved Judge Edelstein retorted.
