Intel Corp has been foiled in its attempt to have its patent lawsuit with Intergraph moved to California from Alabama, Intergraph’s home state to California, where Intel is based. Judge Edwin Nelson has also set June 18 as the day for the sides to meet and decide a timetable for the case. Intergraph is suing Intel because it allegedly used its muscle to coerce Intergraph into giving up certain key patent rights while withholding information about its processors from Intergraph, resulting in the delay of some of its Windows NT workstations. Last week the court denied Intel’s application for an expedited appeal hearing of the preliminary injunction handed down last month, which compelled Intel to continue supplying Intergraph with early samples, early production chips, product information, and production chips during the case.
