INTEL FILES FOR SUMMARY JUDGMENT IN DEC SUIT

Intel Corp has filed a motion for a summary judgment in its breach of contract suit against Digital Equipment Corp. The motion, which an Intel spokesperson called relatively routine, seeks to speed up the legal process by avoiding a suit bogged down with analysis of the technology involved in the case. Intel maintains that the technology issues are superfluous to the breach of contract issue. If the judge agrees with Intel’s request, each company can file a brief outlining its claims and the proceedings will then focus on the specific question of whether DEC has indeed breached its contract with Intel and therefore must return the information and products it borrowed. The motion, and the entire case, have no bearing on DEC’s patent infringement suit against Intel (CI No 3,160). á
