It’s back to square one for Intel Corp and NEC Corp in their battle over the microcode in NEC’s V-series chips: Los Angeles Federal District Judge William Gray, who has taken the case over from Judge Ingram, has denied both companies petitions for summary judgement, and refused to reinstate Judge Ingram’s 1986 ruling that microcode is intrinsically copyrightable; Judge Ingram nullified that ruling when he disqualified himself from the protracted but vital lawsuit.
