HP has filed a lawsuit claiming that Oracle had breached an agreement to support the Itanium microprocessor.
However, Oracle denied the allegations saying that HP explicitly asked them to guarantee continued support for Itanium, which they refused.
HP’s Itanium support guarantee wording was deleted from the final signed agreement, Oracle claimed.
When the agreement was signed in September of 2010, Oracle did not know that there was a plan already in place to end Itanium’s life, which they came to know after six months in March 2011.
At the time of the agreement, HP was concerned about what would happen when Oracle found out about the plan where Intel plans to discontinue Itanium, Oracle said.
Oracle said it believed that Ray Lane and HP’s current board members and Leo Apotheker and HP’s current management team now know well that Intel has plans in place to end-of-life of the Itanium microprocessor.
Moreover, HP knowing this issued numerous public statements in an effort to mislead deceive their customers and shareholders into believing end-of-life Itanium plan do not exist, Oracle claims.
Denying the allegations, Oracle said the lawsuit is utterly malicious and meritless against them.
