The violation does not involve Skype’s internet telephony software, but relates to a Linux-based wireless telephone handset manufactured by SMC Networks that the company has distributed.

The court found that Skype had breached the GPL first by not distributing a copy of the license with the SMCWSKP100 phone, and second by not making the source code available, according to documents made available at ifross.org, an institute headed by Dr Till Jaeger.

Jaeger and his legal firm, JBB Rechtsanwalte, work with gpl-violations.org, which was set up by Harald Welte to protect GPL code from legal violation and brought the case against Skype.
