A federal judge in New York upheld the $208m patent infringement award against Nintendo Co Ltd and said it must pay defunct Alpex Computer Corp 6% of infringing revenues earned from December 1 1992 to May 31 1994, plus prejudgement interest that could be as much as $55.6m: the 1977 patent concerned the ability to reproduce computerised images from a video game electronically so that they can be seen and moved on a television screen and Alpex alleged that the patent laid the basis for Nintendo’s growth in the video-game industry; Alpex, which originally filed its suit in 1986, is being liquidated in federal bankruptcy court in Denver, and the award will go to its creditors.
