Fort Lauderdale, Florida-based Encore Computer Corp reports that National Aeronautics & Space Administration lawyers have told it that a federal court upheld IBM Corp’s protest of the earlier ruling on the disputed $460m NASA contract: IBM appealed to the General Services Administration’s Board of Contract Appeals over NASA’s July ruling to withdraw its choice of IBM as the contractor for the agency’s Operations Automatic Data Processing mainframe computer requirements contract; NASA, in response to Encore’s protest over the selection in May of IBM as the contractor, asked both companies to resubmit bids based on price; Encore has no legal recourse since it didn’t instigate the action, but says it will explore all of its options since it believes its bid was $50m below the tender submitted by IBM.
