Cyrix Corp and Intel Corp have agreed to settle their continuing litigation initiated by Cyrix alleging violations of anti-trust law over maths co-processors and both parties asked the court to dismiss the claims that were to have been heard in October: the terms of the settlement have been agreed upon, but payment depends on the final outcome, after appeal, of the foundry licensing issues, under which Cyrix claimed that by using Intel patents partner SGS-Thomson Microelectronics NV to make its chips, Intel had no patent infringement claim against Cyrix; Cyrix won that one in July last year, and if the US District Court decision is upheld after its final appeal, Intel will make a one-time payment to Cyrix of $500,000; if the ruling is overturned on appeal, Cyrix will pay a one-time $2m to Intel; this settlement in no way affects the other on-going litigation over the Cx386 and Cx486 microprocessors.
