COURT OF APPEALS OVERTURNS BABY BELL DECISION

The US Court of Appeal has overturned Judge Harold Greene’s decision to stay his reluctant decision to allow the Baby Bells to become electronic information providers, saying that the ruling was an abusive discretion, without considering the substance of the issue: Judge Greene said he wanted his decision to grant permission examined by the appeals court before it came into force to avoid the possibility that the Bells would make substantial investments in new services and then be told to desist.
