Typical insurer – takes away the umbrella as soon as the downpour starts: Borland International Inc reports that its insurers have baulked at paying the company’s defence and liability costs in its long-running copyright fight with Lotus Development Corp, the Wall Street Journal reported: three insurers, all part of Chubb Corp, say they aren’t responsible for Borland’s legal costs, estimated at more than $5m by a Borland attorney, or possible liability, which Lotus has suggested could top $100m; Borland attorney Steven Brower said the company’s insurance does cover its legal costs in the Lotus case and that Borland believes the insurers should pay at least part of any liability that might be assessed against the firm.
