ARCHIEVE SUCCESSFULLY OPPOSED MOTION BROUGHT BY CIPHER DATA

Archive Corp, Costa Mesa, California reports that it has successfully opposed a motion brought by Cipher Data Products Inc for a preliminary injunction against it: the motion sought to enjoin Archive from manufacturing and selling some 5.25 quarter inch cartridge tape drives in the US in connection with patent infringement suits between Archive and Cipher that are pending in US District Court for Central California; in separate proceedings, Archive is also claiming that Cipher’s patent actually uses Archive technology licensed to Cipher under 1981 and 1983 agreements, and that Cipher is in violation of the pacts in its new use of the technology.
