Apple lost its appeal against Samsung in Netherlands to ban the sale of its iPad rival, the Galaxy tablet, over allegations of patent infringement.
With this ruling, The Hague Court of Appeals upheld an earlier ruling of a lower court which denied Apple a preliminary injunction against the Galaxy Tab.
Samsung got back at Apple with lawsuits alleging the iPad maker was guilty of infringement of its wireless telecommunications technology.
Apple sued Samsung last year, accusing it of ‘slavishly copying’ its iPad and iPhone through its Galaxy device.
The civil court had turned down Samsung’s argument that Apple should not be allowed to sell devices that use 3G mobile technology patented by it.
The Dutch judge in the latest ruling decided that the Samsung tablet displayed more differences than otherwise, comparing the gadget’s thickness, screen icons and dotted lines with several other design specifications in question.
Had Apple won the appeal, it could have prevented the sale of the Galaxy Tab as it did in Germany the last year.
