Intel Corp is liable to Advanced Micro Devices Inc for breach of contract in one element of the two companies’ dispute, because although the two parties never agreed a spec for AMD’s promised Quad Pixel Display Manager chip, retired Superior Court Judge Barton Phelps, in his role as arbitrator, decided that there was no evidence that Intel ever actually attempted to negotiate performance specs for the part. Judge Phelps ruled that AMD is entitled to damages for Intel’s breaches but deferred ruling on compensation until the damages portion of the arbitration – it could be cash, although Advanced Micro woudl prefer masks to the 80386.
