The court’s ruling follows a lawsuit filed by of Seijiro Tomita of Tomita Technologies, who was a former Sony employee, against Nintendo in 2011.

In January 2012, Nintendo reduced its full- year sales forecast for the 3DS to 15 million units from the earlier projected 17.5 million, while forecasting an operating loss of $208m for the year ending March 2013.
The firm instrumental in creating games, including Super Mario and Zelda, has been struggling to take on tablet computers manufactured by Apple and Samsung.
