Samsung has won a case in the UK with a High Court judge ruling that the Galaxy Tab 10.1 devices do not infringe on Apple’s iPad designs.

Samsung gave a full statement to Pocket-lint, noting that the three of its Galaxy tablets, Galaxy Tab 7.7, Galaxy Tab 10.1, and Galaxy Tab 8.9 have different recognisable traits from the iPad, identified around 50.

Judge Colin Birss said in his ruling the court found numerous Apple design features to lack originality, and numerous identical design features to have been visible in a wide range of earlier tablet designs from before 2004.

"Samsung products are very thin, almost insubstantial members of that family with unusual details on the back. They do not have the same understated and extreme simplicity which is possessed by the Apple design. They are not as cool. The overall impression produced is different," the judge ruled.

The court also found distinct differences between the Samsung and Apple tablet designs, which it claimed were apparent to the naked eye.

The court cited noticeable differences in the front surface design and in the thinness of the side profile, as well as the most vivid differences in the rear surface design, a part of tablets that allows designers a high degree of freedom for creativity, as there are no display panels, buttons, or any technical functions.

"Samsung was recognised by the court for having leveraged such conditions of the rear surface to clearly differentiate its tablet products through visible detailing," the judge ruled.

Samsung said it welcomes the judgment, "As the ruling proves, the origins of Apple’s registered design features can be found in numerous examples of prior art," the company’s statement read.

Apple, which has 21 days to appeal against the court order reiterated its stance, "This kind of blatant copying is wrong and, as we’ve said many times before, we need to protect Apple’s intellectual property."

The latest ruling somes after Apple has won a preliminary sales injunction recently from a US court to stop Samsung from selling its Galaxy Tab 10.1 tablet in US.
