The US Navy has exercised its right to appeal in the case involving a Navy officer, Timothy McVeigh who was to be discharged from the service for allegedly being gay, after information about his personal life was disclosed to the Navy by America Online Inc, his internet service provider. McVeigh won his case at the end of January, preventing his discharge when Judge Stanley Sporkin found that navy investigator had violated both the Electronic Communications Privacy Act, and President Clinton’s ‘don’t ask, don’t tell policy on homosexuality in the armed forces. McVeigh had been the senior enlisted office on a nuclear submarine, but having brought the case he has been reduced to supervising trash disposal, faced a large pay cut and has expressed fears for his safety.
