The New York Senate has approved a proposal signed by Gov. George Pataki, to take effect from November 1.
Any driver caught breaking the new legislation will only receive a verbal warning until December, after which time they will be ticketed and fined up to $100.
Several New York counties have already implemented mobile phone bans and another 39 US states are presently considering similar laws, according to the National conference of State Legislatures.
