Judge Vaughn Walker, sitting in San Francisco, denied Apple Computer Inc’s motion to add fraud charges to its suit against Microsoft Corp and Hewlett-Packard Co over the Macintosh user interface and Windows, but indicated he would allow the company to extend the suit to cover Windows 3 and might permit it to add a complaint that Microsoft violated a duty of good faith and fair dealing in connection with its 1985 licence pact with Apple.
