IBM Corp won a couple of minor victories in its lawsuit against Comdisco Inc, but the bulk of the case will have to go to a jury for a decision: the Delaware court granted summary judgement to IBM, IBM Credit Corp and a limited partnership on two counts that involved the conversion of parts of an IBM Credit computer, including two thermal conduction modules and 128Mb of expanded store and associated parts – Comdisco says it is two gaets and 64Mb memory worth $75,000, which the plaintiffs are now entitled to recover: importantly for Comdisco, the judge denied the motion for summary judgement on the bulk of the case after citing the ambiguity of their contracts in areas of leasing and overleasing computers.
